Network-based services can be provided from anywhere and do not require physical infrastructure, premises or staff in the country where the relevant service is offered. Therefore, relevant electronic evidence is often stored outside of the investigating State or by a service provider established outside of that State, creating challenges regarding the gathering of electronic evidence in criminal proceedings.
