Mutual Trust and Direct Orders to Service Providers Unofficial title
The mechanism of the European Production Order and of the European Preservation Order for electronic evidence in criminal proceedings relies on the principle of mutual trust between the Member States and on a presumption of compliance by Member States with Union law, the rule of law and, in particular, with fundamental rights, which are essential elements of the Union’s area of freedom, security and justice. Such a mechanism enables national competent authorities to send such orders directly to service providers.
